How do I file an opposition against a trademark application at the ÚPV SR?

A couple of requirements need to be met when filing an opposition with the ÚPVSR:

  • 1. The opposition must be filed within three months of the application's publication. No extensions.
  • 2. The opposition fee must be paid in full.
  • 3. The opposition itself must be reasoned and supported by evidence.

The opposition should identify the file reference and publication date of the challenged application, the earlier right on which it is based, the goods or services concerned, and the substantive grounds with supporting evidence. The ÚPV SR opposition fee is €70.

Once filed, the applicant is notified and given the opportunity to respond, and the office decides the matter. Given the procedural and evidential requirements, representation by a trademark attorney is advisable. If your mark has been opposed, get a free initial assessment from Trama's attorneys.
