The ÚPVSR examination stage is twofold. The first is a formal examination that checks whether the application contains all required paperwork and that the fee has been paid. If anything is missing, the office issues a call to remedy the deficiency within a set period.
Second, a substantive examination assesses the mark on absolute grounds: whether it is distinctive, whether it is descriptive or generic, and whether it conflicts with public policy, morality, or other protected signs.
The ÚPV SR does not refuse an application on relative grounds (conflict with earlier marks) on its own initiative. Earlier-rights conflicts are raised by third parties during the opposition period after publication. If the application passes examination, it is published in the Vestník ÚPV SR.
