Trademark oppositions in Slovakia are based on conflicts with earlier rights. The most common ground is likelihood of confusion. A likelihood of confusion occurs when a newly filed trademark is identical or confusingly similar to a previously registered mark.

Other, less common, grounds include: famous marks, earlier trade names, earlier rights in a designation of origin or geographical indication, etc.

Where the earlier mark on which the opposition is based has been registered for more than five years, the applicant can require the opponent to prove genuine use of that mark; if genuine use cannot be shown, the opposition fails on that basis.
