What is a Declaration of Use?

Declaration of Use allows trademark owners to keep their trademark registration alive. It is a signed statement stating that a particular trademark is used in commerce in the US market. A trademark owner will be asked to file the Declaration between the 5th and 6th year from the registration date.

The Declaration must include a signed statement that the trademark is still in commercial use in the US market and evidence (specimen) supporting this claim. Moreover, a list of goods and services must accompany the Declaration. If the Declaration fails to prove the usage of the trademark, the USPTO will cancel the validity of the trademark.
