Can I claim priority from an earlier foreign application when filing with the ÚPV SR?

Yes. Under the Paris Convention, an applicant can claim priority from an earlier application filed in another Paris Convention member country, provided the Slovak application is filed within six months of that first filing.

When priority is claimed, the Slovak application is treated as if it had been filed on the date of the earlier foreign application, which is relevant for establishing precedence over other applications filed in the intervening period.

The priority claim must be made in the application, and the supporting priority document must be provided to the ÚPV SR within the prescribed period (three months from filing); otherwise the claim is disregarded.
