Do I need a trademark for my logo?

You can freely use your logo without a registered trademark, unless you’re not infringing someone’s rights. An unregistered logo carries real risks, though. For one, a competitor can file for an identical or confusingly similar logo and use that registration to challenge your mark. Additionally, a competitor can simply copy your visual identity, with limited legal recourse available to you.

Copyright protection arises automatically upon creation and covers the logo against direct copying, but it does not give you the right to prevent others from using a similar-looking mark independently created. A trademark registration provides that right.
