How do I file an opposition against an EU trademark application?

Oppositions are filed with the EUIPO's Opposition Division, either online through the EUIPO portal or by written submission.

The opposition must be filed within three months of the application's publication date in the EU Trade Marks Bulletin. The notice of opposition must identify the earlier right on which the opposition is based, specify the grounds, and include payment of the opposition fee.

After the opposition is filed, both parties enter a two-month cooling-off period for settlement negotiations. If proceedings continue, both sides submit arguments and evidence before the EUIPO issues a decision.

Given the procedural and substantive complexity of opposition proceedings, representation by a trademark attorney is strongly advisable.
