Yes. Non-US citizens can apply for a US trademark without any restriction based on nationality. Foreign-domiciled applicants are required by law to appoint a licensed US attorney to represent them before the USPTO.

The cost of a US trademark application consists of:

  • Service fee: $240
  • Government fee: $350

These fees cover one class of goods or services. Each additional class carries an additional fee. If the application is filed on an intent-to-use basis, a Statement of Use fee is also due once the mark enters commercial use.
