EU residents and EU-based businesses are not legally required to use a lawyer or representative when filing a trademark application with the EUIPO. Filing independently is permitted.

Non-EU applicants, however, are required to appoint a representative who is authorized to practice before the EUIPO. This typically means a qualified trademark attorney or IP firm based in the EU.

Even where representation is not mandatory, working with a trademark attorney is advisable for applicants unfamiliar with the process. Errors in the goods and services list, or failure to anticipate likely objections, are among the most common causes of avoidable delays and refusals.
