The chances depend on the specific marks and goods and services involved. The key factors are how similar the marks are, how closely the goods or services overlap, and how strong (or weak) the cited earlier mark is.

A refusal based on very similar marks in identical or closely related classes is difficult to overcome without a consent agreement or a significant narrowing of the goods and services. A refusal based on marks that share some elements but have clear visual, phonetic, or conceptual differences; or where the goods and services are in clearly different commercial contexts; is more tractable.

The strength of the cited mark also matters. A highly distinctive earlier mark with a strong commercial reputation commands a broader scope of protection than a weak or widely-used mark in the same space.
