Do we need the trademark Class 35 to sell products on Amazon?

If you have a brand that sells your own products, you won't need class 35. In this case, you should choose the most fitting class based on your goods. For example, you can select Class 3 if you sell skincare products. For clothing, you can go with Class 25.

Class 35 would be fitting in those cases when you are a reseller and sell other brands' products. You can then choose retail services (class 35) and specify what exactly you are selling. For example, 'Retail services in relation to clothing'. However, for Amazon, Class 35 is almost never accepted by the USPTO because, as an Amazon seller, you are not a retailer/wholesaler; the platform is.
