Who can register a trademark in Slovakia?

Any natural person or legal entity can apply to register a trademark in Slovakia. Foreign applicants residing outside Slovakia (and outside the European Economic Area) are required to perform the trademark registration process through a locally registered Slovak trademark attorney. EEA nationals are not required to appoint a local representative but must provide a Slovak address for correspondence.

What does the trademark registration process in Slovakia look like?

1. Create a distinctive sign

For a trademark to be eligible for registration, it must meet specific criteria, one of them being distinctiveness. The more descriptive or customary a name, logo, or other brand element is, the less likely it will be accepted by INDPROP.

2. Conduct prior search

Before filing, it is strongly recommended to search the INDPROP trademark database, as well as EU and international trademark databases, to ensure your mark is not confusingly similar to already registered marks.

3. Submit an application

Applications can be submitted online or in person to INDPROP. The application must include the mark representation, the applicant's name and address, and a list of goods or services classified under the Nice Classification system. A Power of Attorney is required and must generally be submitted within two months of filing.

After filing, INDPROP will conduct:

Examination

INDPROP conducts a formal examination to verify that all required information is present and fees have been paid. It then carries out a substantive examination to assess whether the mark is distinctive and does not conflict with earlier rights.

Publication for opposition

If the application passes examination, it is published in the official Slovak IP Gazette. Third parties then have three months from the publication date to file an opposition.

Registration

If no opposition is filed - or if any opposition is resolved in favor of the applicant - INDPROP registers the trademark and issues a certificate.

How does the trademark opposition process look in Slovakia?

After publication of the trademark application, there is a three-month period during which third parties may file an opposition. The three-month time limit is fixed and cannot be extended.

How long does a trademark last in Slovakia? How can I renew my Slovak trademark?

A Slovak trademark is valid for 10 years from the filing date of the application and may be renewed for additional 10-year periods an unlimited number of times. Renewal can be requested no earlier than 12 months before the expiry date, and there is a six-month grace period after the expiry date during which late renewal is still possible.
